Attorney Greg Snell co-counseled a case brought in Business Court in Orlando on behalf of Arizona based business, Commercial Consultants, LLC versus Orlando based companies, BBA U.S. Holdings, Inc. and Signature Flight Support Corporation. BBA U.S. and Signature are subsidiaries of BBA Aviation plc, a London based publicly traded company. Signature Flight is the largest fixed base operation (FBO) and distribution network for business flight aviation services in the world.
Signature contracted with Commercial Consultants to assist with the acquisition of a number of FBOs for which Commercial Consultants was to have received a 3% of the transaction cost fee. The transaction ultimately closed for 72.5 million dollars but the FBOs were taken by BBA U.S. rather than Signature and BBA. U.S. and Signature claimed they did not owe the fee. After several years of litigating a jury in November of 2011 concluded otherwise finding in favor of Commercial Consultants on all claims against both BBA U.S. and Signature in the full measure of the damages sought.
A judgment has recently been entered for $3,569,099.71 versus Signature and $2,840,609.50 versus BBA U.S. In addition a significant fee and cost claim remains to be determined by the court. Post trial motions, other than those for fees and costs, have been ruled upon. The time for seeking appeal has not yet run.
