Attorney Greg Snell recently spoke to the Volusia Flagler Chapter of the Society for Human Resource Management, a national professional association for human resource professionals, on the 2011 Florida unemployment compensation law reform. On June 27, 2011 Governor Rick Scott signed into law amendments to the Florida unemployment compensation law designed to curb benefit recipient abuse and lower the cost to employers. The Agency for Workforce Innovation ("AWI") began enforcement of the law on August 1, 2011.
Those receiving unemployment benefits now have to file claims and report online, undergo an online skills assessment and either contact five prospective employers a week or report to a One-Stop Career Center for assistance in obtaining a job. A weekly report must be filed and random verification is to be done by the AWI to detect fraud. After the expiration of the federal unemployment benefit extensions, that are now set to end in January 2012 after 73 weeks added to those conferred by the states, a sliding scale is to be used to determine the number of weeks of benefits for which the unemployed will be eligible. If unemployment is 5% or less benefits will be available for 12 weeks, if above, 23.
